Do Not Sell or Share My Personal Information
This notice is jointly issued by ArdinGate LLC (ardingate.com) and ArdinGate Studios LLC (studios.ardingate.com). It applies to both websites and the mobile applications we develop.
Under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), California residents have the right to opt out of the sale or sharing of their personal information, and to limit the use of their sensitive personal information. Similar rights are available to residents of Virginia, Colorado, Connecticut, Utah, Oregon, Texas, Montana, Iowa, Delaware, New Hampshire, New Jersey, Tennessee, Minnesota, Maryland, Nebraska, Indiana, Kentucky, and Rhode Island under their respective state privacy laws.

We Do Not Sell Personal Information
ArdinGate does not sell personal information in exchange for money or other valuable consideration, as that term is defined under Cal. Civ. Code §1798.140(ad). We have not sold personal information in the twelve (12) months preceding the date at the top of this page, and we do not plan to do so.
We Do Not Share Personal Information for Cross-Context Behavioral Advertising
ArdinGate does not share personal information for cross-context behavioral advertising, as that term is defined under Cal. Civ. Code §1798.140(ah). We do not participate in targeted-advertising or profiling programs that would constitute "sharing" under the CPRA. Where we use website analytics (for example, Google Analytics 4), we configure those tools to disable advertising features and identifier-based cross-context tracking to the extent reasonably available.
We Honor the Global Privacy Control (GPC) Signal
ArdinGate recognizes and honors the Global Privacy Control (GPC) browser-based opt-out signal. If your browser or browser extension sends a GPC signal, we treat it as a valid request to opt out of the sale or sharing of your personal information, and as a request to limit the use of sensitive personal information, consistent with the requirements of Cal. Code Regs. tit. 11, §7025 and guidance issued by the California Privacy Protection Agency (Enforcement Advisory No. 2024-01, March 2024).
You do not need to create an account with us for GPC to take effect, and we do not require you to provide additional personal information to respect the signal. The opt-out applies to the browser and device on which GPC is enabled.
Your Rights Under State Privacy Laws
In addition to the opt-out rights above, depending on your state of residence, you may have the following rights:
- Right to Know. Request information about the categories and specific pieces of personal information we have collected about you, the sources, purposes, and categories of recipients.
- Right to Correct. Request correction of inaccurate personal information.
- Right to Delete. Request deletion of personal information we maintain about you, subject to exceptions required by law (e.g., tax records).
- Right to Portability. Request a copy of your personal information in a structured, commonly used, machine-readable format.
- Right to Opt Out of Sale or Sharing. Available as described above.
- Right to Limit Use of Sensitive Personal Information. Request that we use sensitive personal information only for the purposes specifically permitted by Cal. Civ. Code §1798.121(a).
- Right to Opt Out of Profiling. Where profiling is conducted for decisions that produce legal or similarly significant effects, you may opt out. ArdinGate does not currently conduct such profiling.
- Right to Appeal. If we deny your rights request in whole or in part, you may appeal by replying to our response or by sending a new email to privacy@ardingate.com with "Appeal" in the subject line. We will respond to appeals within sixty (60) days.
- Right to Non-Discrimination. We will not discriminate against you for exercising any privacy right.
How to Submit a Request
You can submit a request in one of three ways:
- Browser signal. Enable Global Privacy Control in your browser or via a browser extension. We will honor the signal automatically for visits to our sites on that browser and device.
- Email. Send a written request to privacy@ardingate.com with "Do Not Sell/Share" or the relevant right in the subject line. Include enough detail for us to verify your identity (e.g., the email address you used to contact us, the website on which you provided information, or your client account email).
- Authorized agent. You may use an authorized agent to submit a request on your behalf. We will require proof of the agent's authorization (for example, a signed permission, a power of attorney, or proof that the agent is registered with the California Secretary of State) and may contact you directly to verify the request.
Verification
We will verify your identity using information you have previously provided to us and, where necessary, by asking you to confirm specific details. We will not create new accounts or require additional personal information beyond what is reasonably necessary to verify the request. If we cannot verify you with reasonable certainty, we will deny the request and tell you why.
Timeline
We acknowledge receipt of rights requests within ten (10) business days. We respond substantively within forty-five (45) calendar days. Where necessary, we may extend the response period by an additional forty-five (45) days and will notify you of the extension and the reason.
Sensitive Personal Information
The sensitive personal information we collect is limited to account log-in credentials (username and password) used to access services we host for clients, and, where provided by clients, financial account information for billing. We use this information only for the purposes specifically permitted by Cal. Civ. Code §1798.121(a), including providing the Services, ensuring security and integrity, and complying with legal obligations. We do not use sensitive personal information to infer characteristics about you and we do not retain it beyond what is necessary for these purposes.
Not a Data Broker
ArdinGate is not a "data broker" as defined by Cal. Civ. Code §1798.99.80 and is not required to register with the California Privacy Protection Agency under the California Delete Act. We only collect personal information directly from our own clients, prospects, and site visitors.
